Article 1          This Self-Government Ordinance is formulated pursuant to Article 10 of the Lifelong Learning Act and Article 12, Paragraph 1 of the Community College Development Act.

Article 2          The Competent Authority of this Self-Government Ordinance is Tainan City Government’s Bureau of Education.

Article 3          In order to encourage lifelong learning; provide city residents with lifelong learning opportunities; enhance public participation of city residents; increase the professional and experiential knowledge and civic literacy of city residents; and promote development of community culture as well as revitalize local studies, the Tainan City Government (hereafter, “the government”) shall establish community colleges.

Those seeking to establish community colleges written above should consider the following factors:    

(1) Promote local cultural characteristics.

(2) Focus on the developmental potential of community environments.

(3) Implement balanced urban and rural development. 

(4) Community colleges are also responsible for cooperating with any public or private endeavor contributing to Tainan City’s overall development.

The government shall allocate a certain proportion of budgetary funds for community college affairs.

Article 4          If a community college is to be established by commission, the commissioned entity must be a corporation, incorporated charitable association, or educational institution (hereinafter will be collectively referred to as “trustees”). Trustees must be established or registered according to the law. Trustees are to be determined according to regulations of the Government Procurement Act.

Commissioned trustees mentioned above should clearly state the aim, purpose, or mission of organizing the community college in their articles of association or organizational regulations.

When a community college is to be established by an educational institution by commission according to provisions found in Paragraph 1, its operational results and financial status must be taken into considerations and meet the accreditation criteria stipulated by the Competent Authority.

When carrying out commissioning processes according to provisions found in Paragraph 1, the commission period is limited to five years. Once the period has ended, renewal priority is only given to trustees that receive excellent evaluation scores.

An entity that is not a community college is not permitted to use the term “community college” in its title.

Article 5        The organizational structure of commissioned community colleges should be established by the trustees themselves. The organizational structure should be sent to the Competent Authority.

Commissioned community colleges should establish hiring standards for full-time staff according to their institution’s development needs. The hiring standards should be sent to the Competent Authority.

Article 6          The Competent Authority should provide a venue suitable for the community college to educate students and handle administrative affairs. Or, the trustee may select its own location within an approved area, and then the Competent Authority should be contacted in order to examine and approve the venue.

Article 7       To meet the learning needs of city residents, community colleges may establish branch schools, additional classes, and teaching locations. Those that wish to establish branch schools should report to the Competent Authority and obtain its approval, and those that wish to establish additional classes and teaching locations should notify the Competent Authority for future reference.

To encourage community colleges to conduct teaching in remote areas, the Competent Authority may incentivize and/or subsidize trustees according to their actual needs, so as to create local learning environments and increase local learning opportunities. The competent authority shall also consider the regional characteristics and needs of non-remote areas, and assist with development of their learning environments.

Article 8       A community college should establish a school development committee and short-term, medium-term, and long-term school development outlines. A community college may form a curriculum development group according to its institution’s needs in order to plan and review its institution’s various courses, programs, and recruiting and training of teachers. The above information should be reported to the Competent Authority for future reference.

Article 9       Student recruitment for community colleges is divided into two semesters every academic year, and each course credit should require 18 hours of class instruction. When recruiting students during winter and summer vacations, the Competent Authority should be notified.

Article 10      Community colleges should collect and refund costs according to regulations. No additional costs are to be charged for any other reason(s). The above restrictions do not apply to costs approved by the Competent Authority.

Criteria for collecting and refunding costs written above shall be separately prescribed by the Competent Authority.    

Article 11     To establish community college development policies and review important school matters, the Competent Authority should establish a community college review committee (hereafter, “the committee”).

The composition and operational guidelines of the committee written above shall be separately stipulated by the Competent Authority.

Article 12       The Competent Authority should regularly or irregularly evaluate community colleges. Incentives shall be given to trustees earning excellent scores. Trustees receiving poor scores must make improvements within a determined time limit. If the community college is unable to make said improvements by the time limit, the Competent Authority must consider the severity of the situation(s) when deciding whether to suspend or reduce subsidies and/or terminate the commission relationship.

The regulations for incentivizing and evaluating trustees written above shall be separately stipulated by the Competent Authority.

Article 13     Community college students attaining a certain level of learning achievements are qualified to obtain a credit program certificate, completion of schooling certificate, or a lifelong learning graduation diploma awarded in the name of the city mayor.

The regulations of awarding students written above shall be separately stipulated by the Competent Authority.

Article 14      This Self-Government Ordinance shall take effect from the date of promulgation.
